Purpose 

This Sofy.ai Acceptable Use Policy (“AUP”) applies to the use of any product, service or website provided by us (Sofy.ai), whether we provide it directly or use another party to provide it to you (each, a ” Sofy.ai Service”). This AUP is designed to ensure compliance with the laws and regulations that apply to the Sofy.ai Service. This AUP also protects the interests of all of our clients and their customers, as well as our goodwill and reputation. These terms are so important that we cannot provide the Sofy.ai Service unless you agree to them. By accessing or using our services, you agree to comply with this Policy. Please read it carefully before proceeding.  

Sofy.ai reserves the right to modify this AUP at any time, without notice, at our sole discretion. The revised terms will become effective upon posting on this website. We recommend that Customers regularly check this AUP for any updates. Continued access or use of the Software Services after the posting of revised terms implies your agreement to comply with and be bound by those revised terms. If there is any conflict between this AUP and any other referenced policy or agreement, this AUP will govern unless specifically stated otherwise in the respective policy or agreement. This AUP provides examples of conduct considered inappropriate, improper, or harmful to Sofy.ai, its third-party service providers’ computer networks, computer systems, and services. Such conduct is strictly prohibited.  

Policy 

General Use & Unacceptable usage:  

1. You shall not use Sofy.ai in any way that violates applicable laws, regulations, or this Policy. Prohibited activities include, but are not limited to: 
   1.1 You may access, use, or share Sofy.ai proprietary information only to the extent it is authorized.
   
   1.2 Illegal Activities: Engaging in any activity that is illegal, fraudulent, or involves the unauthorized access, use, or distribution of intellectual property or personal information. 
   
   1.3 Harmful Content: Uploading, transmitting, or distributing any content that is unlawful, threatening, defamatory, obscene, or harmful to individuals or entities. 
   
   1.4 Malicious Software: Introducing any viruses, worms, Trojan horses, or other harmful code that could disrupt, damage, or impair Sofy.ai or its users’ experience.
   
   1.5 Unauthorized Access: Attempting to gain unauthorized access to Sofy.ai, other users’ accounts, or any system or network connected to Sofy.ai, or bypassing any security measures in place. 
   
   1.6 Spamming and Phishing: Sending unsolicited bulk messages, spam, or phishing emails through Sofy.ai, or engaging in any deceptive practices to obtain sensitive information. 
   
   1.7 Impersonation: Falsely representing yourself as another individual, entity, or representative of Sofy.ai to deceive or harm others. 
   
   1.8 Violation of Privacy: Collecting or storing personally identifiable information of other users without their consent or engaging in any activity that infringes upon privacy rights.  

 Data Usage and Security: 

2. When using Sofy.ai, you are responsible for the data you upload, store, or process. You agree to:
2.1 Service is available for organizational use only and not for resale. Pricing is based on minutes of usage not exceeding commercially reasonable limitations. Unlimited plans and features are offered for specific plans.

2.2 Compliance with Laws: Ensure that the data you handle through Sofy.ai complies with all applicable laws and regulations regarding data protection, privacy, and confidentiality. 

2.3 Confidentiality: Protect confidential information, trade secrets, or sensitive data shared within Sofy.ai and refrain from disclosing such information to unauthorized parties. 

2.4 Security Measures: Implement appropriate security measures to protect your own data and systems from unauthorized access, including the use of strong passwords, two-factor authentication, and encryption where applicable. 

2.5 Third-Party Data: If you handle personal data or information of third parties through Sofy.ai, ensure that you have the necessary permissions, consents, or legal basis to do so, and comply with relevant privacy laws. 

User Conduct: 

3. While using Sofy.ai services, you agree to:
   3.1. Compliance with Policies: Abide by all applicable terms of service, policies, and guidelines set forth by Sofy.ai, including this Acceptable Use Policy.
   
   3.2. Respectful Communication: Interact with other users in a professional and respectful manner, refraining from engaging in harassment, discrimination, or any behavior that causes harm or distress.
   
   3.3. Reporting Violations: Promptly report any suspected violations of this Policy or any security concerns to Sofy.ai’s support team.  

Consequences of Violation: 

4. Violation of this Policy may result in various consequences, including but not limited to:
   
   4.1. Suspension or Termination: Sofy.ai may suspend or terminate your access to the platform in response to any violations, abuse, or repeated non-compliance with this Policy.
   
   4.2. Legal Action: Sofy.ai reserves the right to pursue legal remedies when necessary to protect its rights, users, or the integrity of its services.

5. Sofy.ai reserves the right to update or modify this Acceptable Use Policy at any time without prior notice. Any changes will be effective upon posting the updated Policy on our website. We encourage you to review this Policy periodically.
